Man Sues After Fall in St. Louis

A man fell in a stairwell in St. Louis and was injured. He is now suing the owner of the property in a premises liability lawsuit. He claims that the stairwell was unlit and was not properly marked off with a partition. The fall happened in March.

According to the complaint filed Nov. 1 in St. Clair County Circuit Court, the defendants carelessly and negligently permitted the sidewalk at the entrance of the premises to become and remain in a dangerous condition.

The man is asking for damages over $100,000 to compensate for his injuries, medical expenses and time off work.

Gillette Wal-Mart Sued for Slip and Fall

A Campbell County man fell in a local Wal-Mart store in 2005 and injured his knee. He filed a premises liability lawsuit against the company in court last week. His lawyer argues that he reinjured a knee that has been operated on previously.

Dick Baker was shopping at the store Feb. 20, 2005, when the accident happened. He walked around the end of an aisle, stepped into a pool of water caused by a leaking roof and fell, according to court documents. The spot was not marked off with warning signs.

The fall caused the man nerve damage and chronic pain. The lawsuit is asking for an unnamed amount of damages. Wal-Mart has not commented on the case.

Safety Agency Fines Boyd Gaming $185,000 After 2 Workers Die

Nevada's OSHA fined Boyd Gaming $185,000 for nine safety violations stemming from the tragic deaths of two of its employees at the Orleans hotel-casino in Las Vegas. The two men died when they entered a manhole inside the casino to clear blocked grease. Their deaths were caused by toxic gas exposure. To read more about the workplace fines click here.

CT DOT Cuts Backs On Bridge Safety Inspections

The Connecticut Department of Transportation has cut back on bridge inspections across the state over the past two years. Under its new policy, the DOT will inspect most bridges half as often as outlined under federal standards, and less often than it did at the time of the 1983 Mianus River Bridge collapse, which killed three and caused the state to improve its inspection standards. 2 Year Old Boy Critically Injured in Pool Accident

A 2-year-old boy remained in critical condition this morning after he was found Sunday at the bottom of a pool during a family party, police said. Antonio Capetillo of Hartford was attending a birthday party with his family on Elm Street in East Hartford when he went through an unlocked gate surrounding an above-ground swimming pool and fell into the water. The police continue to investigate this tragic accident.

Judge Bork Files Slip and Fall Lawsuit

Judge Robert Bork, former Supreme Court nominee, has filed a personal injury lawsuit, alleging that he injured himself as a result of a slip and fall accident at the Yale Club last year. He seeks compensatory and punitive damages. This lawsuit is noteworthy because Judge Bork has written on many subjects, including the need for tort reform. The plaintiff's tort bar and personal injury lawsuits are often criticized and wrongfully so. In many cases, those being critical change their opinion when they are injured as a result of another's negligence.

Connecticut Slip and Falls - Legal Overview

Property owners, landlords, property managers and places of business including grocery stores, shopping malls, gas stations, bars, nightclubs and hotels, have a duty to their visitors and customers to maintain their property in a reasonably safe condition. They have a duty to inspect the property from time to time to make sure that no hazards or defects exist. If a dangerous condition is detected, the property owner has to take reasonable measures to repair or eliminate the hazard. With regards to snow and ice, a property owner must remove snow and ice from driveways, walkways and parking lots within a reasonable time after the snow fall ends.
Slip and fall injuries routinely occur as a result of a property owner's failure to inspect or repair the property. If you have suffered a slip and fall injury, it is important to take the following steps: 1) report the incident to the property owner or manager; 2) seek medical attention; 3) photograph the defective condition if possible; 4) if the defective condition has been fixed or removed, photograph the location of the fall; and 5) contact our attorneys. Due to certain statute of limitations and statutory notification provisions for certain slip and fall claims, it is vital to contact us as soon as possible following the slip and fall incident.

Connecticut Adopts Mode of Operation Rule, Slip and Falls

The Connecticut State Supreme Court recently adopted the mode of operation of rule. This rule is extremely important for people injured as a result of a fall down (slip and fall) at a self service store. Self service stores are supermarkets, cafeterias, fast-food restaurants and other businesses where the customer selects the merchandise or food from the displays as opposed to an employee getting the product or food for the customer. Negligent Snow Removal Contractors

With the snow, sleet and ice falling, there will undoubtedly be slippery areas on driveways, walkways, sidewalks and parking lots over the next few days. Property owners and tenants have a duty following a storm to remove accumulations of snow and ice so that the property is reasonably safe. If the snow and ice is not properly removed and someone falls causing injury, the property owner or tenant is liable for the injuries and losses suffered. In many instances, a person that is an employee at a store or business falls on snow and ice in the employer's parking lot or walkway. Typically, the injured employee assumes that he or she only has a workers' compensation claim because the fall took place on the employer's property and it happened during the course of his or her employment. This is not the case. If the employer used a snow removal contractor, the contractor would be liable for injuries caused by the contractor's negligence in faling to properly remove the snow and ice. Therefore, if you slip and fall on snow or ice at your job, you may have two claims: 1) a workers' compensation claim; and 2) a negligence claim against the snow removal contractor. This is important because in the negligence claim you can recover compensation for pain and suffering, mental anguish and the loss of the enjoyment of life's activities. These items of damages are not compensable through workers' compensation.
