Dry Drowning Warning For Parents

The death of a 10-year-old boy from South Carolina this week while lying in his own bed, has brought attention to the little known “dry drowning.”

Johnny Jackson had gone for a swim in his neighborhood and walked home with his mother. He seemed fine except that his mother says he soiled himself, and then started talking slowly. He was sleepy. He lay down to take a nap and about one hour later he was dead.

Parents need to understand how dry drowning works. When water gets into the lungs, and it doesn’t have to be much, a child can asphyxiate. Lungs immersed in fluid are unable to take in oxygen from the air, but even with a small amount of water, Wikipedia says the “laryngospasm reflex essentially causes asphyxiation and neurogenic pulmonary edema.”

Basically when you breath, the diaphragm contracts, increases the volume of air into the lungs from the outside. During laryngospasm the person’s larynx spasm shuts. Air does not rush into the lungs. The heart is beating the blood flowing but it is not picking up oxygen.

Dry drowning can happen when someone has forceful contact with the water, such as from high diving or a water slide. Or just from summer fun in a pool, or even from a bath.

But the signs can be delayed and doctors don't know why. Signs are extreme fatigue and strange behavior which results from a reduction in oxygen to the brain. They need to get to an emergency room and have a breathing tube inserted so oxygen can be forced into the lungs so they regain their function.

3,600 people drowned in 2005, according to the CDC. About 10 to 15 percent were dry drownings, which can occur up to 24 hours after water is breathed into the lungs.

Johnny's mother, Cassandra Jackson, just didn't know, like most of us wouldn't.

Obama Citizenship Lawsuit Headed to U.S. Supreme Court?

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

Philip J. Berg, the lawyer who filed suit against Barack Hussein Obama, challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court.

Yesterday, Judge R. Barclay Surrick dismissed the suit brought by Berg, ruling that Berg did not have standing to bring the suit. In his lawsuit, the Plaintiff, Berg, a Philadelphia attorney, alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old, to regain his U.S. citizenship status. The lawsuit raises not only the Indonesian citizenship issue but also questions whether Obama was a citizen of Kenya.

Mr. Berg has stated that if Barack Hussein Obama will produce a certified "vault" birth certificate, a copy of his Certificate of Citizenship and a copy of his Oath of Allegiance to the United States, that he (Mr. Berg) will dismiss his lawsuit voluntarily. To date, Obama has refused to comply with Mr. Berg's request.

Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court. This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?.....What happened to ‘...Government of the people, by the people, for the people?"

Berg's lawsuit is not the only one filed, challenging Obama's eligibility. There are apparently as many as 8 lawsuits currently pending.

In Honolulu, Andy Martin, a longstanding critic of Mr. Obama, filed a lawsuit, asking the Hawaiian Department of Health to release Mr. Obama's birth certificate records.

In the state of Washington, Steven Marquis, a resident of Fall City, Wash., a town about 30 miles southeast of Seattle, has filed a lawsuit against Washington Secretary of State Sam Reed, demanding that Mr. Reed verify Mr. Obama's citizenship status. The complaint seeks specifically that the office of the Washington Secretary of State verify and certify that Mr. Obama is or is not a "natural born" citizen by producing original or certified verifiable official documents. The lawsuit argues that this certification should take place before the election to preclude a constitutional crisis.

The interesting question to be possibly answered by the U.S. Supreme Court is whether voters, whether Republican, Democratic or Independent, have a right, under the Constitution, to challenge the eligibility of a presidential candidate. Hopefully, if that question is to be addressed by the Supreme Court, it will be decided before the election on November 4.

Second Citizenship Lawsuit Filed Against Barack Obama

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

A second lawsuit has been filed against Democratic presidential nominee Sen. Barack Obama over his lack of evidence of U.S. citizenship.

Steven Marquis, a resident of Fall City, Wash., a town about 30 miles southeast of Seattle, has filed a lawsuit against Washington Secretary of State Sam Reed, demanding that Mr.

Mr. Marquis argues the secretary of state has the authority and duty to not only certify the voters but also and most importantly the candidates and in so doing prevent the wholesale disenfranchisement of voters who would had had an opportunity to choose from qualified candidates had the certification preceded the election process.

Mr. Marquis' lawsuit is the second to be filed seeking proof that Mr. Obama is a U.S. citizen qualified to run for the office of U.S. president. Philip Berg, an attorney who wants Mr. Obama to produce his original birth certificate, filed another suit in Pennsylvania earlier this year.

"At this point, Mr. Obama has not allowed independent or official access to his birth records nor supporting hospital records," wrote Mr. Marquis in a statement. "The Hawaii Health Department has violated Federal law by ignoring formal Freedom of Information requests for the same. Due to the facts and numerous other allegations that would challenge Mr. Obama's fundamental qualifications for office, a Federal lawsuit was filed and is currently being heard in District Court, Pennsylvania."

The Pennsylvania case is being heard by Judge R. Barclay Surrick, who has not made any ruling in the case.

The Washington lawsuit demands injunctive relief directing Mr. Reed to carry out the duty of his office in this regard answering the formal complaints for verification of Mr. Obama and any other candidate appearing on the ballots issues through his office for which formal complaints have been received. The State of Hawaii has refused to release copies of Mr. Obama's birth certificate, because the privacy statutes of the state prevent them from doing so.

In Honolulu, Andy Martin, a longstanding critic of Mr. Obama, filed a lawsuit on Oct. 17, in an attempt to get the Hawaiian Department of Health to release Mr. Obama's birth certificate records.

"One of Mr. Obama's most controversial and contentious issues that he has allowed to fester for years is the question of his birth certificate," said Mr. Martin in a statement. "Mr. Obama has posted at least two versions, maybe more, of a 'certificate' on the Internet. "I want to see a certified copy issued by the State of Hawaii, not one issued by the State of Mr. Obama," he continued. "Why Mr. Obama won't allow direct access to his birth records is beyond me. But the closer we get to discovering the truth about Mr. Obama the more we understand why he is terrified of that truth."

According to the U.S. Constitution, "no person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this constitution, shall be eligible to the office of president; neither shall any person be eligible to that office who shall not have attained to the age of 35 years, and been 14 years a resident within the United States."

The parties (and the country) await decisions by the judges in these cases. See affliated blogs on this subject at this link and this link and this link.

U.S. Supreme Court Asked to Delay Presidential Election

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

According to a press release from attorney Philip J. Berg, he filed a request with the United States Supreme Court on Thursday afternoon, for an injunction staying the presidential election until the Supreme Court determines whether Barack Hussein Obama is eligible to be President of the United States.

According to Mr Berg, he has filed two documents:

Application for an Immediate Injunction to Stay the Presidential Election of November 4, 2008; and

Petition for Writ of Certiorari.

Berg stated, “I am hopeful that the U.S. Supreme Court will grant the Injunction pending a review of this case to avoid a Constitutional Crisis by insisting that Obama produce certified documentation that he is or is not a “natural born” citizen and if he cannot produce documentation, that Obama be removed from the ballot for President".

Berg’s original lawsuit, Berg vs. Obama, was dismissed by the United States District Court for the Eastern District of Pennsylvania last Friday, for lack of standing. Berg questions the logic of the District Court's decision:

"This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?"

The interesting question to be possibly answered by the U.S. Supreme Court is whether voters, whether Republican, Democratic or Independent, have a right, under the Constitution, to challenge the eligibility of a presidential candidate.

With the presidential election a mere five days away, the Supreme Court will need to act quickly. It is unknown whether Berg asked for an emergency hearing.
Originally posted at InjuryBoard by Brian W.
Obama Files Motion in Citizenship Lawsuit

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

Attorneys for Barack Hussein Obama filed a motion in Federal Court in Pennsylvania on Monday, asking the court to dismiss the Amended Complaint filed by Philip J. Berg. The lawsuit filed by Berg challenges Obama's eligibility to take the office of the President of the United States. The motion to dismiss filed by Obama and the Democratic National Committee, echoes Obama's prior motion to dismiss the action for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted.

In his lawsuit, the Plaintiff, Philip J.

To date, Obama has refused to comply with Mr. Berg's request.

Obama Citizenship Lawsuit To Be Amended To Add Defendants

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

Philadelphia attorney Philip J. Berg has sought court approval to amend his complaint in a lawsuit styled Berg v. Obama. The amended complaint would add the Pennsylvania Department of State, the Secretary of the Commonwealth Pedro A. Cortes (in his official capacity), the U. S. Senate Committee on Rules and Administration, and Senator Diane Feinstein (in her official capacity as chairman) for their failure to exercise due diligence with respect to Barack Hussein Obama's constitutional qualifications to be elected and serve as President of The United States, and for his inclusion on the ballot in Pennsylvania as a candidate for President of the United States.

In his original complaint, Mr. Berg alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old to regain his U.S. citizenship status.

According to a web site maintained by the Plaintiff, the amended complaint is intended to clarify issues regarding the plaintiff's standing to bring the lawsuit and supplement the lawsuit with additional relevant facts. Those additional facts are summarized at that web site.

According to the Washington Times, the Obama campaign has firmly said the Illinois Democrat is a natural-born citizen. Last month, the campaign posted on Obama's Web site a copy of his certification of live birth. It says he was born in Honolulu on Aug. 4, 1961. The Obama web site, commenting on questions regarding whether Obama is a citizen of Kenya, cites FactCheck.org as follows:

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

The issue of Obama's citizenship have been the topic of internet sites for months. Documents and photographs, claiming that Obama was registered in schools in Kenya under the name of Barry Soetoro, have been circulated through a variety of blogs and web sites which has fueled the debate. The Berg lawsuit raises not only the Kenyan citizenship issue but also questions whether Obama was a citizen of Indonesia. According to the allegations of the Plaintiff, Obama lost his U.S. citizenship when his mother married an Indonesian citizen, Lolo Soetoro, who legally “acknowledged” Obama as his son in Indonesia and/or “adopted” Obama, which caused Obama to become a “natural” Indonesian citizen.

The parties are waiting on the court to rule on a motion to dismiss filed by Barack Hussein Obama. Lawyers for Obama and the Democratic National Commitee have also filed a motion for a protective order staying discovery in the case until the court rules on the motion to dismiss.

E-Cigarette…Anyone Else?

The FDA has alleged that one of several E-cigarette distributors in the United States, Smoking Everywhere, Inc. (SE), has marketed a product that is both an unapproved drug (nicotine) and an unapproved medical device (synthetic cigarette body).

The FDA made this determination after examining the product, several claims made about the product, and information that SE, itself, provided to the FDA. For further information, please read E-cigarette Anyone?

While class I medical devices (gauze pads, throat sticks and the like) do not necessarily need FDA approval, class II or III medical devices do require FDA clearance before legal marketing can occur. The FDA has classified the E-cigarette as a class III medical device, and as such that device must undergo the strictest FDA scrutiny before it can reach the marketplace.

Depending on the manufacturer and type, the cost of entry to use E-cigarettes can vary from $14.99 for the “disposable” version all the way up to more than $200.00 for reusable deluxe models. Complete “starter kits” with cartridges and batteries included have been advertized at around $100. While the $200.00 price tag might discourage younger users, the chic of it all and the curiosity to try an E-cigarette at the price of about three packs of cigarettes ($14.99) might entice a younger demographic to give it a try.

Most people who use E-cigarettes do so with the intention of cutting down on smoking, or with the anticipation being able to get a nicotine high while working indoors (no smoke = no ban). Other consumers use the device to quit smoking altogether. Cessation is possible because the nicotine concentrations in the cartridges can range from 16 mg all the way down to zero mg. The choice remains with the consumer.

There can be no dispute that well designed and well regulated E-cigarettes have a potential to aid smokers in reducing or eliminating their habits. And several manufacturers are heading in the direction of making the E-cigarette device as safe as possible.

However, E-cigarettes might also provide an avenue for further addiction. A first time E-Cigarette user with the handle, “Utada” recently posted an after purchase review on Amazon.com. Although Utada was going to give the SE distributed E-cigarette five (5) stars, Utada only gave the product three (3) stars because he or she felt that the product was addictive since it had nicotine.

But here's the catch. When Utada was smoking real cigarettes, she smoked only 5 or 6 a day. However, with the E-cigarette, Utada wound up smoking two cartridges a day (each cartridge being equal to 20 regular cigarettes). Utada continued her review by advising the purchase of “e-cig juice” an after market nicotine cartridge rejuvenator, which comes in different flavors. With e-cig juice (or E.LIQUID, as one example), Utada expected to save a lot of money. In fact, using e-cig juice to extend the life of the device, reduces the cost of “smoking” significantly to far less than $5.00+ a pack for 20 smokes (see below). But there is a potential health hazard in using an E-cigarette beyond the number of cycles that the manufacturer has built into the device; an example follows.

Recently, several complaints have surfaced about a burning taste that consumers experience after cycling the E-cigarette through a number of puffs. This phenomenon may or may not involve SE’s version of the E-cigarette, but it would be prudent to obtain more information from the manufacturer.

As one blogger illustrated, most E-cigarette devices contain a wick inside a filament that soaks up the liquid in the cylinder that contains nicotine. A battery powered filament then heats the liquid that finds its way to the wick to form a vapor. After a while, the wick dries out fairly easily and starts to burn forming “burnt e-liquid”). Thereafter, the residual E-liquid has a propensity to turn into a solid and begin to burn. That sequence is what creates an unwelcome taste, and a possible, device-related health hazard. With little regulation, the possibilities for serious health risks seem as endless as human creativity will permit.

For example, some ardent E-cigarette consumers have expressed concern that manufacturers may be using a cheap polyester material to make the filter portion of the cigarette. Polyester filters could turn out to be dangerous when burned and inhaled.

Moreover, E-cig liquid is sold in 15 milliliter bottles in several flavors and nicotine strengths for $14.99. According to one distributor, only 2 or 3 drops of the liquid will regenerate a cartridge. Since there are 20 drops per milliliter, that means that one 15 milliliter bottle contains from 100 to 150 cartridge refills, and one cartridge equals 20 cigarettes. Doing some simple math, like many young people are able to do, a cigarette equivalent could cost as little as $14.99 divided by 3000, or about half a cent (or 10 cents a pack). It’s a great way to beat the cigarette tax.

To reiterate, the E-cigarette is a device, nicotine is a drug, and the FDA will be regulating both. Therefore it is within the purview of the FDA to ensure the safety of the E-cigarette device and its delivery of a drug. Otherwise, problems associated with misuse and/or device alteration might abound

Bottom line: In the interest of consumer safety, the FDA should require all E-cigarette manufacturers list materials used in respective devices. In addition, the FDA should require E-cigarette manufacturers to conduct studies to determine whether any materials subject to heat during cycling, including polyester, might produce toxins. Smart manufacturers should be forthcoming with appropriate warnings and, lastly, all forms of nicotine, including E-cig juice should be FDA regulated.

Internet Rumors Fueled by Obama Citizenship Lawsuits

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

Despite rumors circulating on the internet, a decision has not been reached by the judge in the lawsuit pending against Barack Hussein Obama in Federal Court in Philadelphia.

Judge R. Barclay Surrick is pondering a number of motions from both sides, but has yet to rule.

Several web site and blog posts have claimed that the judge entered an order, ruling in favor of the Plaintiff and has ordered Obama to cease and desist campaigning for President. Others have claimed that Obama has admitted the allegations of the lawsuit by failing to respond to Request for Admissions filed by the Plaintiff. The confusion appears to be caused by the “proposed” orders that are typically attached to a motion, when filed by a party. When the Plaintiff in the Philadelphia case, Philip Berg, filed a motion asking the court to determine that Obama admitted the allegations of the lawsuit by not responding, he attached a proposed order. If that order is signed by the judge, it would have the result that is being spread through the internet. Until that point, no ruling has been made.

The Berg lawsuit alleges that Defendant Barack Hussein Obama is not eligible for the Office of the President, because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia. Plaintiff further alleged that Obama followed her naturalization and failed to take an oath of allegiance when he turned 18 years old to regain his U.S. citizenship status.

Other internet blogs and stories have circulated suggesting that Barack Hussein Obama's sudden trip to Hawaii is in response to the lawsuit filed on October 17 in Hawaii and not related to the health of his grandmother. Earlier this week, Obama announced that he was suddenly suspending his campaign to fly to Hawaii to visit his gravely ill grandmother. That announcement came shortly after Andy Martin, a longstanding critic of Mr. Obama, filed the lawsuit in Hawaii, asking the Hawaiian Department of Health to release Mr. Obama's birth certificate records to prove that he is a natural born citizen. Obama's campaign has denied the claim that the trip is related to the lawsuit.

The parties (and the country) continue to await decisions by the judge in the Berg case.

Barack Obama Seeks To Block Discovery in Citizenship Lawsuit

DISCLAIMER: The author is a registered Independent and does not have an opinion as to the truth and/or veracity of the allegations of the lawsuit referenced in this blog or the information contained at the web sites cited.

In a lawsuit styled Berg v. Obama, lawyers for Barack Hussein Obama have filed a Motion for Protective Order, seeking to block discovery until his motion to dismiss is ruled on by the court. The Motion for Protective Order filed by Obama and the Democratic National Committee, asks the court to issue a protective order stopping "all discovery in this action pending the Court's decision on defendant's motion to dismiss the action for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted."

In his lawsuit, the Plaintiff, Philip J. Berg, a Philadelphia attorney, alleged that Defendant Barack Hussein Obama is not eligible for the Office of the President because Obama lost his U.S. citizenship when his mother married an Indonesian citizen and naturalized in Indonesia.

The motion to block production of documents is just the latest in a series of filings in the case, but has become a focal point of the suit. According to a web site maintained by the Plaintiff, the Plaintiff requested that three documents be produced by Obama:

1. a certified copy of Obama’s “vault” (original long version) Birth Certificate;

2. a certified copy of Obama’s Certificate of Citizenship; and

3. a certified copy of the Oath of Allegiance taken by Obama at the age of majority.

Mr. Berg asserts that if Barack Hussein Obama will produce the above documents and prove his eligibility for the Office of the Presidency, that he (Mr. Berg) will dismiss his lawsuit voluntarily. To date, Obama has refused to produce these documents to Mr. Berg.

Grandmother Blames Gardasil In Granddaughter's Death

Jessie Ericzon was 17-years-old and about to graduate from high school.

Like many girls her age, she was given the first of the three-shot series of Gardasil, the Merck drug that is supposed to protect young girls from the human papillomavirus, or HPV, that causes two types of cervical cancer and two types of warts.

That was 19 months ago.

Jessie had no health problems, but after the second shot in September 2007 she started to get bad headaches, as well as muscle aches, and joint pain, says her grandmother, Denise Melton. Last February she got the third shot in the series, two days later she was dead.

Her grandmother said after the final shot Jessie said she had a headache and went to bed. That next morning her mother found her on the bathroom floor. "Without a shadow of a doubt, I know that Gardasil is what killed her," says Melton.

An autopsy was inconclusive.

Jessie is not alone. There have been at least 43 reports of deaths following the vaccine and the CDC and FDA have collected about 14,000 adverse events including muscle numbness and paralysis, also known as Guillian-Barre Syndrome, headaches, and fainting.

Let's not forget that Merck is the same company that brought us Vioxx, and knew or should have known that heart attack and strokes would result from the painkiller which was eventually taken off the market.

Even the American Cancer Society says that cervical cancer has declined by 74 percent between 1955 and 1992, largely due to the Pap test.

No one really knows if Gardsil works to prevent cervical cancer, but parents should know that about 80 percent of women are exposed to HPV over their lifetime and their natural immunities fight it off. They should also know that if their child is injured, they have no recourse through the courts. Merck enjoys immunity from liability, as to all vaccine makers.

Melton is going to take Jessie's death as far as she can. She has written to the governor and Congress. She has a license plate that says "One Less" in reference to the Merck campaign by the same name. What she wants one less of, is young woman or girls dying from the drug that is supposed to deliver a cure. #
Originally posted at InjuryBoard by Eddie Farah
