    Bob Carroll | June 29, 2006 5:46 PM | 0 CommentsTampa Bay, FL

The summary of the case sounds almost academic. Claims based on injuries intentionally inflicted by an insurance carrier during claims administration process are not barred by workers' compensation immunity JOSEPH THRISTINO v. CRAWFORD & COMPANY; PARTNERS IN HEALTH; TENET HEALTH CARE CORPORATION, 4th District, 31 Fla. L. Weekly D1761aBut the allegations of the complaint are far from academic. ...

  • No Benefits for Injured Workers

    Robert Blanchard | June 19, 2006 12:54 PM | 0 CommentsPensacola, FL

More Worker Compensation lawyers are quitting their practice as a result of the bad laws made by the Florida legislature. Since attorneys can no longer earn a sufficient fee when the carrier fails to make medical payments or lost wage payments, injured workers will not be able to get lawyers to represent them. I guess it doesn't matter until it happens to you.

  • Florida Courts Say One Thing And Do Another In Workplace Injuries

    Bob Carroll | June 17, 2006 6:24 AM | 0 CommentsTampa Bay, FL

Or, it further eliminates the ability of injured workers to bring civil actions against the wrongdoers who...

    Bob Carroll | May 18, 2006 2:21 PM | 0 CommentsTampa Bay, FL

An injured worker is legally entitled to file a worker's compensation claim without fear of retaliation by his employer. Sometimes, however, the employer decides to retaliate by firing the injured employee or by taking some other adverse action. When that happens, the law provides for a cause of action against the employer. Ex-UPS driver to get $6 million over firing for being 'injury...

  • It Ain't Easy Being Mickey

    Bob Carroll | April 10, 2006 8:42 AM | 0 CommentsTampa Bay, FL

Visitors to the theme parks of Florida may not appreciate the pain and suffering going on under those character costumes. The word from China is that being Mickey or Pluto is not a walk in the park. In Florida, the Workers' Compensation law requires that the employer provide a safe workplace. If costumed characters are regularly experiencing physical problems, which may be the case, I would...

The new stardard for worker exposure to harmful chromium are not only inadequate, they took way too long to be inacted. The Occupational Safety and Health Administration's (OSHA) new standard to reduce worker exposure to hexavalent chromium is seriously inadequate and will not protect the safety of hundreds of thousands of workers who are exposed to the metal in the workplace. OSHA will publish...
