      <title>Proposed Legislation Would Protect Consumers, Hold Insurance Companies Accountable</title>
      <description>&lt;p&gt;Earlier this week, Democrats in the &lt;a href="http://www.house.mi.gov/"&gt;Michigan House of Representatives&lt;/a&gt; introduced a package of bills that would strengthen consumer protection and prevent &lt;a href="http://lansing.injuryboard.com/automobile-accidents/insurance-companies-not-the-supreme-court-to-blame-for-high-rates.aspx?googleid=270756"&gt;auto insurance&lt;/a&gt; companies from engaging in unfair trade practices. The proposed law, which is made up of ten separate bills, represents a significant step toward safeguarding consumers' interests.&lt;/p&gt;
&lt;p&gt;Under the current law, insurance companies can consider someone's credit history, education, and occupation when setting insurance rates. The new &lt;a href="http://detnews.com/article/20091130/BIZ/911300347/Tougher-insurers--rules-to-be-proposed"&gt;law&lt;/a&gt; would prohibit this practice, as well as prevent auto insurance companies from raising an individual's rate following an &lt;a href="http://www.lansingstatejournal.com/article/20091130/OPINION02/911300312/1087/OPINION02"&gt;accident&lt;/a&gt; if he or she was not at fault. In addition, the state &lt;a href="http://www.michigan.gov/dleg/0,1607,7-154--226924--,00.html"&gt;insurance&lt;/a&gt; commissioner would have to sign off on any potential rate increases.&lt;/p&gt;
&lt;p&gt;The new bill package essentially adopts the recommendations put forth by &lt;a href="http://lansing.injuryboard.com/automobile-accidents/michigan-auto-insurance-battle-continues.aspx?googleid=256690"&gt;consumer&lt;/a&gt; advocates in February of this year. Despite its brutal economic climate, &lt;a href="http://www.michigan.gov/"&gt;Michigan&lt;/a&gt; ranks in the top quarter of all states in terms of total auto insurance premiums.&lt;/p&gt;
&lt;p&gt;Until now, auto insurance companies have been able to fix rates based on irrelevant and discriminatory information.       <title>Pair of Holiday-Weekend Accidents Result in Death, Injury</title>
      <description>&lt;p&gt;Two young &lt;a href="http://www.cityoflansingmi.com/"&gt;Lansing, Michigan&lt;/a&gt; residents fell victim to &lt;a href="http://www.lansingstatejournal.com/article/20091129/NEWS01/311290001/1001/NEWS"&gt;car crashes&lt;/a&gt; over the Thanksgiving holiday - a sobering reminder of the hazards of one of the busiest &lt;a href="http://lansing.injuryboard.com/automobile-accidents/safe-driving-is-something-to-be-thankful-for.aspx?googleid=274916"&gt;travel&lt;/a&gt; seasons of the year.&lt;/p&gt;
&lt;p&gt;Christy Luckett, 30, died Thursday morning, one day after a two-vehicle &lt;a href="http://maps.google.com/maps?hl=en&amp;amp;source=hp&amp;amp;q=waverly+road+and+phoenix+drive+lansing&amp;amp;um=1&amp;amp;ie=UTF-8&amp;amp;hq=&amp;amp;hnear=S+Waverly+Rd+%26+Phoenix+Dr,+Lansing,+MI+48911&amp;amp;gl=us&amp;amp;ei=2BkTS73jIoGwtAP489G7DA&amp;amp;sa=X&amp;amp;oi=geocode_result&amp;amp;ct=image&amp;amp;resnum=1&amp;amp;ved=0CAwQ8gEwAA"&gt;crash&lt;/a&gt; at the intersection of Waverly Road and Phoenix Drive in Lansing.  The driver and one passenger in the other vehicle were also treated for injuries.  The collision is still under investigation.&lt;/p&gt;
&lt;p&gt;Some 50 miles away in &lt;a href="http://oceolatwp.org/"&gt;Oceola Township&lt;/a&gt;, Zachery Warren was injured when he swerved to avoid a pickup truck driven by Clem Plowman on M-59 in Livingston County.  Warren, a 23-year-old Lansing man, is still receiving treatment at &lt;a href="http://www.med.umich.edu/"&gt;University of Michigan Medical Center&lt;/a&gt; in Ann Arbor.&lt;/p&gt;
&lt;p&gt;Remember to use extreme caution when driving.       <title>Advanced Technology Showing How PTSD Alters Brain Function</title>
      <description>&lt;p&gt;For years people suffering from &lt;a href="http://www.stress-relief-resources.com/post-traumatic-stress-disorder.html"&gt;post traumatic stress disorder&lt;/a&gt; (PTSD) were dismissed as complainers and fakers.  Their cases were given little to no serious consideration from the medical community and from society at large.  Slowly, that has started to change.  As our National News Desk at &lt;a href="http://www.injuryboard.com/national-news/traumatic-brain-and-ptsd-disorders-seen-in-scans.aspx?googleid=274420"&gt;InjuryBoard&lt;/a&gt; highlighted, PTSD is now listed in the diagnostic manual used by psychiatrists and psychologists along with the criteria for making the diagnosis.&lt;/p&gt;
&lt;p&gt;Up until now, however, PTSD has largely been diagnosed through its symptoms without a significant method of objectively testing just how the mind has been affected by the traumatic events that led to the disorder.  That is slowly starting to change.  New and powerful imaging tests are being developed to detect just how the brain changes in people with PTSD.  The disease that was once &amp;quot;just in your head&amp;quot; is turning out to be the result of damage to the brain's nerve fibers that handle memory and confusion. &lt;/p&gt;
&lt;p&gt;The technique is called &lt;a href="http://www.northjersey.com/news/health/other_health/Scanning_invisible_damage_of_PTSD_brain_blasts_.html"&gt;Diffusion Tensor Imaging&lt;/a&gt;.  It is a non-invasive procedure adds just a little time to a standard MRI.  It involves tracking how water flows through tiny, celery stalk-like nerve fibers in the brain, measuring the direction and speed of the water molecules to determine if the nerve fibers have suffered any damage. &lt;/p&gt;
&lt;p&gt;While this research has been primarily driven by the waves of veterans from Afghanistan and Iraq who has suffered from PTSD and &lt;a href="http://www.neurotrauma.org/2009/abstracts/pdf/P267.pdf"&gt;Traumatic Brain Injuries&lt;/a&gt; (PDF), the ramifications of this technology can be far reaching.  Countless Americans suffer from PTSD and traumatic brain injuries, ranging from an auto accident to surviving traumatic events such as a rape or child abuse.  &lt;a href="http://wtop.com/?nid=106&amp;amp;sid=1807645"&gt;Treatment&lt;/a&gt; for all these individuals will likely be altered from this research as scientists learn more about how the brain heals itself from traumatic events.&lt;/p&gt;

      <title>Deer Involved in Lansing 2 Car Crash</title>
      <description>&lt;p&gt;With &lt;a href="http://www.michigan.gov/dnr/0,1607,7-153-10363_14518-174079--,00.html"&gt;deer hunting season&lt;/a&gt; officially open in Michigan for nearly 2 weeks, most of the talk about deer has to do with how big a buck you shot or taking your children for their first hunt.  I'm pretty sure that opening day for deer hunting is one of the biggest holidays in Michigan.  Sometimes, however, the deer are out to get you and not the other way around.&lt;/p&gt;
&lt;p&gt;Just this morning a car near &lt;a href="http://maps.google.com/maps?f=q&amp;amp;source=s_q&amp;amp;hl=en&amp;amp;q=S+Waverly+Rd+%26+W+Jolly+Rd,+Lansing,+Ingham,+Michigan+48911&amp;amp;sll=42.683319,-84.60258&amp;amp;sspn=0.010947,0.020428&amp;amp;ie=UTF8&amp;amp;cd=1&amp;amp;geocode=FeJKiwIdOA_1-g&amp;amp;split=0&amp;amp;hq=&amp;amp;hnear=S+Waverly+Rd+%26+W+Jolly+Rd,+Lansing,+Michigan+48911&amp;amp;ll=42.683114,-84.603074&amp;amp;spn=0.010947,0.020428&amp;amp;z=16"&gt;Jolly and Waverly&lt;/a&gt; in &lt;a href="http://www.lansingstatejournal.com/article/20091125/NEWS01/311250002"&gt;Lansing hit another car after a deer came onto the road&lt;/a&gt;.  According to the police, just after 6 am the driver of a Chevy Impala was either hit by a deer or swerved to miss hitting a deer and crashed into a van.  The driver of the Impala was ejected from her car during the crash.  Both drivers and one passenger were transported to the hospital for treatment.&lt;/p&gt;
&lt;p&gt;Here are some tips from the &lt;a href="http://www.michigan.gov/msp/1,1607,7-123-1589_1711_4587-16230--,00.html"&gt;Michigan State Police&lt;/a&gt; to keep you safe if you encounter a deer and how to avoid them.  Have a safe and happy holiday.&lt;/p&gt;

      <title>Car Crash in Oneida Township Kills DeWitt Teenager</title>
      <description>&lt;p&gt;&lt;a href="http://www.lansingstatejournal.com/article/20091123/GRANDLEDGE01/911230344/1001/NEWS/DeWitt-teen-dies-in-Oneida-Twp.-crash"&gt;Travis Rademacher&lt;/a&gt;, a 19 year old &lt;a href="http://www.wilx.com/news/headlines/71581582.html"&gt;DeWitt teenager&lt;/a&gt;, was killed in a &lt;a href="http://www.lansingstatejournal.com/article/20091124/NEWS01/311240013/1001/NEWS/Police--DeWitt-man--19--dead-after-2-car-crash"&gt;car accident &lt;/a&gt;last Saturday in Oneida Township when his vehicle collided with another car driven by Matthew Merrill of Lansing. The crash occurred after Mr. Rademacher stopped at a stop sign on &lt;a href="http://maps.google.com/maps?f=q&amp;amp;source=s_q&amp;amp;hl=en&amp;amp;geocode=&amp;amp;q=M-100+and+St.+Joe+Hwy+Eaton+County+MI&amp;amp;sll=42.726555,-84.737334&amp;amp;sspn=0.021879,0.040855&amp;amp;ie=UTF8&amp;amp;hq=&amp;amp;hnear=Michigan+100+%26+St+Joe+Hwy,+Grand+Ledge,+Eaton,+Michigan+48837&amp;amp;ll=42.726334,-84.739648&amp;amp;spn=0.021879,0.040855&amp;amp;z=15"&gt;St. Joseph Highway before turning onto M-100&lt;/a&gt;. Both Mr. Rademacher and his passenger were wearing their seatbelts at the time of the crash. &lt;a href="http://www.legacy.com/obituaries/lsj/obituary.aspx?n=travis-j-rademacher&amp;amp;pid=136378064"&gt;Mr. Rademacher&lt;/a&gt; was transported to a Lansing area hospital, but unfortunately he passed away a short time after the crash.&lt;/p&gt;
&lt;p&gt;It's not entirely clear what caused this crash.  Darkness could have played a factor in the crash since it happened after sunset.  Another factor could have been the speed of the car traveling on M-100.  Or it could be that both drivers are inexperienced, given they were both under the age of 20, and also not paying attention to the other cars on the road.  Our blog has talked a number of times about the dangers of distracted driving, most recently concerning &lt;a href="http://lansing.injuryboard.com/automobile-accidents/put-the-brakes-on-driving-while-texting.aspx?googleid=266182"&gt;text messaging&lt;/a&gt;. &lt;/p&gt;
&lt;p&gt;While we don't know what caused this crash to occur, we should nonetheless be mindful of the potential causes of accidents and do our best to be attentive drivers.       <title>Safe Driving Is Something to Be Thankful For</title>
      <description>&lt;p&gt;This holiday weekend, people will be traveling in droves to reunite with their families and to celebrate &lt;a href="http://www.history.com/content/thanksgiving"&gt;Thanksgiving&lt;/a&gt;. Given that airline tickets are prohibitively expensive for most people with the current state of the &lt;a href="http://www.whsv.com/home/headlines/70408017.html"&gt;economy&lt;/a&gt;, much of the Turkey Day traffic will be on our roadways. Unfortunately, this could translate to a higher chance of being involved in an &lt;a href="http://lansing.injuryboard.com/automobile-accidents/holiday-accidents-underscore-importance-of-safety.aspx?googleid=252314"&gt;accident&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;With millions of Americans traveling such significant distances, the opportunity for &lt;a href="http://autos.aol.com/gallery/thanksgiving-ticket-guide"&gt;disaster&lt;/a&gt; also climbs. You can do your part to minimize the risk to you and your family by practicing safe driving behaviors:&lt;/p&gt;
&lt;ul&gt;
    &lt;li&gt;Driving too fast is widely recognized as dangerous, but driving too slow can also cause hazardous situations as well.&lt;/li&gt;
    &lt;li&gt;If you're tempted to drive a few extra miles to get to your destination despite being sleepy, don't. &lt;a href="http://drowsydriving.org/"&gt;Drowsy driving&lt;/a&gt; can be as dangerous as driving drunk.&lt;/li&gt;
    &lt;li&gt;Be patient. People will be clogging highways from Wednesday night through Monday morning. Be prepared to deal with delays to avoid &lt;a href="http://www.edmunds.com/reviews/list/top10/110033/article.html"&gt;road rage&lt;/a&gt;-type behavior.&lt;/li&gt;
    &lt;li&gt;Weather can be a factor. If the skies open up with rain or snow, be sure to adjust your driving accordingly.&lt;/li&gt;
&lt;/ul&gt;
&lt;p&gt;Many law enforcement agencies will be patrolling the highways this weekend, on the lookout for these behaviors.  Their goal is to keep everyone safe by ticketing violators and, hopefully, detering motorists from dangerous driving.&lt;/p&gt;

      <title>Virginia Research Librarian Struck by Bus Wins $8 Million in Damages</title>
      <description>&lt;p&gt;Richmond, Virginia: a research librarian at the Library of Virginia who was struck by a &lt;a href="http://www2.timesdispatch.com/rtd/news/local/article/GRTC19_20091118-222803/306676/"&gt;GRTC Transit System&lt;/a&gt; bus in 2007 recently won &lt;a href="http://www.newsplex.com/home/headlines/70506627.html"&gt;$8 million in damages&lt;/a&gt;.  &lt;a href="http://www.wric.com/Global/story.asp?S=11536907"&gt;Meikiu Lo&lt;/a&gt;, age 34, suffered spinal and shoulder damage, multiple hip and pelvis fractures, and has suffered chronic pain since her accident in which a GRTC bus struck her as she crossed the street beside the library.  Lo had waited on the sidewalk until the street was clear prior to crossing and was also approximately 2/3 of the way across, when the bus struck her while making a right turn.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The jury deliberated for one hour prior to reaching their decision to award Lo the entire amount in damages that her attorneys requested on her behalf.  The medical evidence presented in the case showed that Lo will likely undergo multiple surgeries for hip replacement before she reaches 50 years old.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The bus company offered to settle the case for $1.8 million, and also fired the bus driver at fault.  However, this isn&amp;rsquo;t the only &lt;a href="http://wjz.com/wireapnewsva/Va.woman.severely.2.1321940.html"&gt;bus accident&lt;/a&gt; that the company will have to deal with; in fact, on September 30, 2009, Loucendia Reed Lambert, age 55, was struck by a &lt;a href="http://stage-v2.wtopnews.com/?nid=25&amp;amp;sid=1817320"&gt;GRTC bus&lt;/a&gt; while crossing the street to her job at the Department of Health.  She subsequently died as a result of her injuries.       <title>TMJ Injuries Common to Rear-End Collisions</title>
      <description>&lt;p&gt;A &lt;a href="http://www.lectlaw.com/med/med04.htm"&gt;temporomandibular joint (TMJ) injury&lt;/a&gt; is one of the most common related to &lt;a href="http://www.mayoclinic.com/health/tmj-disorders/DS00355"&gt;rear-end collisions&lt;/a&gt;, but has received very little attention until very recently. The TMJ is described as a ball and socket arrangement so that the jaw is able to open and close. This fragile construction is especially sensitive to injury during traumatic car crashes. Furthermore, pain is more commonly attributed to head or neck injuries, in general. Nevertheless, &lt;a href="http://www.emedicinehealth.com/temporomandibular_joint_tmj_syndrome/article_em.htm"&gt;TMJ disorders&lt;/a&gt; are progressive, and if left untreated, can increase impairment over the long run.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;a href="http://www.stevedds.com/tmd.htm"&gt;TMJ injuries&lt;/a&gt; that are caused by rear-end collisions occur as a result of whiplash. For example, when there is a sudden impact from behind, the head can snap in many different directions. When this happens very quickly the neck muscles cannot relax and therefore hold the jaw still. In the meantime, the head is forced backwards by an impact and the mouth opens and hyper extends, causing injury to the jaw. Ultimately, the muscles and supporting ligaments in the &lt;a href="http://www.tmj.org/"&gt;TMJ&lt;/a&gt; are torn, which results in scar formations. It is the scar formations that cause pain to an injured individual.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Unfortunately, few medical and dental practitioners have the specialized training needed to diagnoses TMJ injuries. However, a diagnosis can be made with thorough physical examination, including radiographic surveys.       <title>Theft and Joyriding Lead to Pursuit and Death in Oak Park, MI</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;15-year-old &lt;a href="http://www.freep.com/article/20091110/NEWS02/91110029/?imw=Y"&gt;Desean Murrell Fant&lt;/a&gt; died after crashing a &lt;a href="http://www.dailytribune.com/articles/2009/11/11/news/srv0000006794562.txt"&gt;stolen car&lt;/a&gt; into a tree in the early morning hours of November 10, 2009 in Oak Park, MI.  Desean and another 15-year-old child had allegedly stolen a 1999 Saturn that belonged to a 24-year-old Oak Park resident.&lt;/p&gt;
&lt;p&gt;After locating the vehicle, &lt;a href="http://www.myfoxdetroit.com/dpp/news/oak-park-car-crash-091110"&gt;Oak Park&lt;/a&gt; &lt;a href="http://www.clickondetroit.com/news/21570239/detail.html"&gt;police&lt;/a&gt; ensued on a car chase.  The boys were not wearing seat belts when they lost control of the vehicle.  The police had been pursuing the boys for several blocks and Michigan State Police are reconstructing the crash to learn more about the boys' speed at the time of collision.&lt;/p&gt;
&lt;p&gt;Local residents noted that the &lt;a href="http://www.detnews.com/article/20091110/METRO02/911100409/1361/Dearborn-Heights-teen-dies-in-crash-after-police-chase"&gt;speeding&lt;/a&gt; car was zooming.  It is unfortunate and tragic that the need to go on a joyride or steal property would lead to taking such &lt;a href="http://www.clickondetroit.com/news/21572163/detail.html"&gt;dangerous&lt;/a&gt; risks.  The risks were not only to their own lives, but to the lives of any other pedestrian or driver.&lt;/p&gt;
&lt;p&gt;It is also unfortunate that death is the price that was paid by these kids for stealing a car.  If these kids had been caught and arrested, I don't think anyone would find death a reasonable punishment for the crime they committed, but that's the sentence they received when the situation escalated.  Did the police really need to engage in a high speed pursuit to catch these kids for stealing a car?&lt;/p&gt;

      <title>Local Motorcyclist Exemplifies Fact that Helmets Save Lives</title>
      <description>&lt;p&gt;I recently wrote about &lt;a href="http://lansing.injuryboard.com/motorcycle-accidents/motorcycle-accidents-can-cause-serious-injuries.aspx?googleid=273890"&gt;motorcycle accidents and the serious injuries&lt;/a&gt; they can cause.  A logical and simple answer to increase &lt;a href="http://www.msf-usa.org/downloads/helmet_CSI.pdf"&gt;motorcycle safety (pdf)&lt;/a&gt; is to wear a &lt;a href="http://www.lansingstatejournal.com/article/20091108/NEWS01/911080546"&gt;helmet&lt;/a&gt; while riding. A local man is a testament to this fact: &lt;a href="http://www.mlive.com/news/muskegon/index.ssf/2009/10/jimmy_hunter_struggles_to_reco.html"&gt;Jimmy Hunter&lt;/a&gt;, a 56-year-old musician from Muskegon and a Harley-Davidson motorcycle rider, suffered a brain injury after he was in a car accident two years ago.  However, his injuries would&amp;rsquo;ve been much worse if hadn&amp;rsquo;t worn a helmet.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Along with purchasing a Harley-Davidson Sportster, Hunter also purchased one of the best helmets available.  In fact, it was a full-face helmet.  Hunter admits he might have looked &amp;ldquo;silly&amp;rdquo; going down the road, but he readily adds that if he had worn a smaller helmet, he wouldn&amp;rsquo;t have survived.  In fact, Hunter was injured after a vehicle pulled out in front of him, even though he was following the speed limit.  Although the accident left him in critical condition for weeks, and he still has difficulty moving freely on his own, he continues outpatient therapy and hopes to ride his Harley again soon.&lt;/p&gt;
&lt;p&gt; &lt;/p&gt;
&lt;p&gt;In Michigan, &lt;a href="http://www.nhtsa.dot.gov/people/injury/pedbimot/motorcycle/motosafety.html"&gt;motorcycle deaths&lt;/a&gt; have increased slightly, from 124 in 2007 to 127 in 2008.  While deaths are up statewide, fatalities decreased in Ingham, Clinton, and Eaton counties between 2007 and 2008.  Hopefully, the decline in deaths can be partially attributed to other riders who put safety first and wear helmets while riding their motorcycles.  At least in Hunter&amp;rsquo;s case, his helmet saved his life.&lt;/p&gt;
