Class Action Status Denied in Ford, Firestone Case

An Illinois Federal Appeals Court has denied class action certification of millions of product liability claims stemming from the recent Ford Explorer/Firestone tire fiasco. The appeals court said competing state laws and the countless reasons for tire failure would have made class action litigation "unmanageable." Because of the decision, attorneys must now pursue lawsuits on an individual basis. The ruling, which overturns two class certifications granted in November 2001 by U.S. District Judge Sarah Evans Barker in Indiana, affects plaintiffs seeking financial retribution for diminished resale value of their vehicle and for emotional stress.
