A Florida court ruled this week that a 7-year-old girl could sue her mother for injuries she sustained as a fetus in a 1994 car accident. Kara Goodman's mother, Barbara Goodman, had argued for her daughter's right to sue. If Kara wins the lawsuit, Barbara Goodman's insurer, National Casualty Company, will be forced to pay her daughter's medical expenses.
A spokesperson for National Casualty said that the ruling was a "mistake" and would "interfere in a relationship between a mother and her fetus." But the 3rd District Court of Appeal said the decision was "a logical extension of existing Florida law." In Florida, a child has the right to sue his or her parents for negligence.
