Dow Chemical Loses West Virginia Asbestos Lawsuit

A West Virginia jury has ruled that the remaining defendant in an asbestos lawsuit involving more than 2,000 plaintiffs is liable for injuries caused by exposure to the toxic substance. In their suit, the plaintiffs alleged that Dow Chemical Co.'s Union Carbide unit's products and facilities caused serious asbestos related injuries. The case originally included claims by 8,000 plaintiffs and 259 defendant companies, all consolidated into one trial. All of the defendants, except for Dow, settled out of court either before or just after the U.S. Supreme Court rejected an appeal to have the lawsuit dismissed because the cases were too unrelated. The ruling opens the possibility for future litigation against Dow Chemical.
