Families Settle With Condo Association

The families of two tourists killed in a 1998 scuffle at the New Smyrna Beach Ocean Palms Beach Club will share a $300,000 settlement. The only survivor of the fight will also share in the settlement. Although the condominium had filed bankruptcy three months before the April 16th fight, it maintained insurance which will pay the settlement amount.

The lawsuit alleged the condominium was negligent because premises security was inadequate and allowed trespassers onto the property. The families of the three victims agreed to the settlement in lieu of filing separate lawsuits. In March of this year, Jonathan Trull, of Oak Hill, Florida, was convicted of two counts of first-degree murder and one count of attempted second-degree murder for his part in the incident.
