A Clearwater, Florida man who was shot during a SWAT team drug raid last summer has filed a lawsuit against the Pinellas County Sheriff's Office. Torrance Marshall, 26, claims that his civil rights were violated when he was shot during an allegedly unlawful search and seizure operation conducted by the sheriff's office. Marshall was unarmed at the time. SWAT deputy Eric Gibson says he lost his balance while entering the home and accidentally fired his 9mm into Marshall's mouth. In addition, Gibson insists Marshall "came at him" initially.
Currently serving a three-year prison sentence, Marshall was arrested on multiple drug charges after being released from the hospital. Officers discovered 105 grams of crack cocaine, marijuana, and a revolver during the raid. Marshall is seeking $5 million in the suit.
