Despite the fact that a jury has already found the jailers of 33-year-old Philippe Le Menn not guilty in the French national's death, the family of Le Menn is still hopeful that further investigation by the FBI will prove the Las Vegas jail responsible for his death. The family of Le Menn hopes the FBI investigation will lead to Federal charges.

Philippe Le Menn, a local restaurant manager, was arrested on January 4, 2001 after acting strangely outside a local school in Las Vegas. While in jail, Le Menn became upset and caused a violent struggle while officers were trying to move him to an observation cell. Le Menn later died. The official cause of death is asphyxiation, but the coroner's inquest was not able to identify exactly what happened before his death, not to mention who was responsible for it.

According to lawyers for Le Mann's family, the department did not properly train its officers in handling mentally disturbed people. They further stated that Le Menn was subjected to "cruel, inhuman and degrading treatment." The lawsuit names the Metropolitan Police Department, Sheriff Jerry Keller, and nine correctional officers as defendants and asks for compensatory and punitive damages.
