      <title>Post Accident Medical Treatment</title>
      <description>&lt;p&gt;  One factor in auto accident  or truck accident cases is post accident medical treatment. After the accident,what you do matters. There are three factors . First , a delay in treatment will kill your case. Did you go to the hospital soon after the accident or did you wait days if not weeks. Second , the reputation of the medical provider will be called into question. Was it your primary care doctor or another medical provider that gave treatment ? Lastly , were you over treated for a routine injury. I would also add to this list is did you follow your doctor's orders.       <description>&lt;p&gt;            As everyone continues to better understand the money woes facing our great country, investors have questions on what happened to their life savings.       <title>Not All Crooks Carry Guns</title>
      <description>&lt;p&gt;     After weeks of news reports of all the financial problems , I have come to the conclusion that not all crooks carry guns. They carry paper and pens. The Wall Street Fat Cats have stolen more money in a shorter amount of time than Jesse James and all the crooks in the world. What are we do now that we have been taken advantage of by these thiefs ? Fight back. The Tennessee Consumer Protection Act gives a consumer some recourse if these companies or salespersons have engaged in any deceptive business practices. I am currently reviewing claims on these types of cases. Please make a post in the comment section .       <description>&lt;p&gt;   This week is fire prevention week . For some reason, October is the month with the largest number of house fires. Let's review a couple of safety tips. Cooking causes the largest number of fires.However more people die in fires involving smoking materials or heaters. So, pay attention to what is on the stove and in the oven.Don't leave anything on the stove unattended. Also, make sure the cooking area is free from anything that might catch on fire such as a dish towel. Each year thousands of people lose their lives in fires.       <title>Most Nursing Homes Violate Federal Standards</title>
      <description>&lt;p&gt;    More than 90 percent of U.S. nursing homes were cited for violating federal standards. The Inspector General of the Health and Human Services Department reports that for profit nursing homes have a higher percentage of violations than public nursing homes. the most common problems are related to improper storage and distribution of food , accident hazards ,and lack of services neceassry for the residents well being. You can go to the Medicare web site for more information on the nursing homes that fail to meet these standards of care. It appears that nursing homes cut costs on employees who can monitor patient care to make sure the elderly are feed and to prevent falls in the nursing home.       <title>Invasion of Privacy and Intercepted Emails</title>
      <description>&lt;p&gt;           Yesterday, I discovered a Tennessee law that has some teeth to it regarding invasion of privacy. The creates civil liability for any person whose wire,oral,or electronic communication is intentionally intercepted,disclosed,or used in violation of T-C-A 39-13-601. I have been practicing law since 1994 and I always get excited when I learn some new law about a hot topic. These issues of email tampering or hacking into social networking accounts has been coming up recently.       <title>Palin E-mails , The Right of Privacy, and The Internet</title>
      <description>&lt;p&gt;              A student at the University of Tennessee is alleged to hacked into Governor Palin's emails. It also happens in divorce cases that one spouse will look at private emails as well. Tennessee has enacted some tough laws to prevent invasion of privacy of electronic communication. Tennessee Code Annotated section 39-13-603 provides civil damages for unauthorized email interceptions. It provides for damages to personal or business reputation,statutory damages of $100.00 per day or $10,000.00 whichever is greater, punitive damages, and attorney fees. I was not aware of this statute even existed until I did some research on the issue. Our office is now accepting cases to protect ones right to privacy of their emails and other types of electronic communication. As Governor Palin realizes emails should stay private and there are laws to protect that privacy.       <title>Myspace , Evidence , and Your Case</title>
      <description>&lt;p&gt;If you have been injured in any type of accident case, your life becomes an open book. An insurance company or  an insurance defense lawyer will investigate your background. I recently had two cases where the myspace page made a case and severely damaged another. Social networking sites are great. I even have a linkedin page. Once you put up photos,comments, or whatever type of information , it is posted into cyberspace. In one case , I was able to discredit a witness using his myspace page as impeachment evidence. The other case was not so good for my client. The bottom line is if you are in a personal injury case be careful what is on your website or pages.       <title>New Efforts to Reduce Motorcycle Accident deaths</title>
      <description>&lt;p&gt;                      The U.S.Department Of Transportation announced new safety measures to improve motorcycle safety.The motorcycle safety measures include new national safety and training standards for new bike riders , an effort to curb counterfeit helmet labeling , place new focus on motorcycle-specific road improvements , and provide more training to police on how to spot unsafe drivers. It turns out the U.S Department of Transportation Secretary Mary Peters is herself a biker. She suffered a motorcycle accident in 2005 where she broke her collar bone.       <title>Motorcycle Traffic Deaths Rise Again</title>
      <description>&lt;p&gt;                   The National Highway Traffic Safety Adminstration (NHSTA) reported that motorcycle accident deaths rose by 5.1 percent , to 4,810 in 2006 . Traffic deaths rose for all age groups , but older riders were affected the most. In the last 10 years , fatalities have risen by 250 percent in the 40-and-older age group.One reason is the increased power of the engines and the size of some of the bikes.Often older riders return to biking with the same skills that were safe 20 years ago. Alcohol also plays a role in motorcycle crashes in all age groups. The report shows that 39 percent of 35-to-39-year-olds killed in a fatal crash had a blood alcohol level of .08 or higher. Does the lack od helmets cause the death rates to rise ? Only 20 states have mandatory helmet laws. Tennessee is one such state. Does a state's right to regulate safety issues trump the bike riders personal choice and freedom to ride. I would like to hear your comments which I will post on this site.
